General Terms and Conditions of the FACE-SHINE.COM OG – Face-Shine Training of 27 October 2015

§ 1 Validity of the terms and conditions

1.1 Deliveries and services of theFACE-SHINE.COM OG – Face-Shine Training are carried out exclusively on the basis of the following General Terms and Conditions (“GTC”) in the version valid at the time of the order. The customer can view, download and print the valid version of the Terms and Conditions on the website of the FACE-SHINE.COM OG – Face-Shine Training. 

§ 2 Contract

2.1 The contractual partners are the customer and FACE-SHINE.COM OG – Face-Shine Training, Stiftgasse 15-17, 1070 Vienna. Contract, order and business language is exclusively German.

2.2 The goods and services displayed on the FACE-SHINE.COM OG – Face-Shine Training web pages (the “purchased goods” or the “purchased goods”) are a non-binding invitation to the customer to order this purchased item (s). With the order, the customer makes a binding offer. The offer of the customer becomes effective as soon as the order reaches FACE-SHINE.COM OG – Face-Shine Training.

2.3 FACE-SHINE.COM OG – Face-Shine Training can accept an offer within five business days of receipt. After the deadline has passed without notice, an offer is deemed rejected. The acceptance takes place by sending an order confirmation or by sending the ordered purchase item (s). The shipping date is decisive for maintaining the acceptance period. Order confirmations can also be sent by e-mail.

2.4 If the order confirmation or any other legally binding statement of FACE-SHINE.COM OG – Face-Shine Training contains typographical or typographical errors or should the pricing be subject to transmission errors, FACE-SHINE.COM OG – Face-Shine Training shall be entitled to the declaration of error to challenge. Any payments received will be refunded in this case.

2.5 For contracts for the provision of services, services are rendered exclusively to the customer personally; any measure which directly or indirectly allows a third party to deliver a service to a third party is inadmissible.

§ 3 Condition of the purchased object

3.1 The nature of the object of sale underlying the contract arises exclusively from the manufacturer’s information. Deviations require a written agreement.

§ 4 Prices and terms of payment

4.1 All prices quoted are in Euro and are inclusive of the applicable statutory sales tax. For packaging and shipping of physical goods a shipping fee of EUR 5, – will be charged. From an order value of Eur 50, – the shipping is free for the customer.

4.2 All prices and other conditions are only valid for shipping within Austria. Decisive are always the prices valid at the time of the order. With the updating of the FACE-SHINE.COM OG – Face-Shine Training website, all previous prices and information on purchased goods will be void.

4.3 Payment is by Paypal or by credit card (Visa, Mastercard).

4.4 The payment amount shown on the invoice must be paid in full to FACE-SHINE.COM OG – Face-Shine Training, regardless of the method of payment. Transaction fees of any kind whatsoever are the sole responsibility of the customer.

§ 5 Withdrawal (Withdrawal)

5.1 It is pointed to the right of withdrawal of the customer.

5.2 If the customer is a consumer according to the statutory provisions, he has the right to withdraw from this contract within fourteen days without giving reasons (right of withdrawal). The cancellation period is fourteen days from the day on which the customer or a third party named by him, who is not the carrier, has taken possession of the purchased item. If he receives the purchased item in several partial shipments, the withdrawal period begins on the day on which he or a third party named by him, who is not the carrier, has taken possession of the last partial shipment. For contracts for the provision of services, the withdrawal period is fourteen days from the date of the conclusion of the contract.

To safeguard the withdrawal period, it is sufficient for the customer to send the notice of the exercise of the right of withdrawal before the expiry of the withdrawal period.

5.3 For the exercise of the right of withdrawal, a clear statement (for example, a letter sent by post) of the decision to withdraw from the contract must be addressed to FACE-SHINE.COM OG – Face-Shine Training:

The item to be purchased must be sent to the following address: FACE-SHINE.COM OG – Face-Shine Training, Stiftgasse 15-17, 1070 Vienna. In the case of contracts for the provision of services, the service may no longer be used and actions of whatever kind which cause the provision of further services by FACE-SHINE.COM OG – Face-Shine Training.

5.4 The right of withdrawal does not apply to contracts for the delivery of purchased goods that are not prefabricated and for the manufacture of which an individual selection or determination by the customer is authoritative or which are clearly tailored to the personal needs of the customer.

The right of withdrawal expires prematurely in contracts for the delivery of sealed goods, which are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery; for the supply of purchased goods, if, due to their nature, they were inseparably mixed with other goods after delivery; to supply computer software in a sealed package when the seal has been removed after delivery.

5.5 If the customer has withdrawn from the contract, he shall immediately return to FACE-SHINE physical purchases and face-shine trainings, and in any event not later than fourteen days from the date on which he notifies FACE-SHINE.COM OG  of withdrawal from the contract. The term is respected if the purchased goods were sent before the expiration of the period of fourteen days.

In the event of a contract cancellation, FACE-SHINE.COM OG – Face-Shine Training has received all payments that FACE-SHINE.COM OG – Face-Shine Training received from the customer, including delivery charges (except for the additional costs that may result show that the customer has selected a different type of delivery than the offered, most favorable standard delivery), immediately and within fourteen days at the latest from the day on which the resignation at FACE-SHINE.COM OG – Face-Shine Training is received. For this repayment, FACE-SHINE.COM OG – Face-Shine Training uses the same method of payment used in the original transaction, unless otherwise expressly agreed. FACE-SHINE.COM OG – Face-Shine Training may refuse to refund until the item purchased has been returned or until evidence has been provided that the item has been returned.

In the event of a timely cancellation, FACE-SHINE.COM OG – Face-Shine Training will bear the cost of the return.

§ 6 Delivery terms

6.1 Deliveries of physical goods are made to the delivery address provided by the customer. For contracts for the provision of services, the delivery takes place by providing a username and a password. The service is available through the use of username and password from the website FACE-SHINE.COM OG – Face-Shine Training.

6.2 Delivery is by Austrian Post.

6.3 All deliveries are subject to the condition that FACE-SHINE.COM OG – Face-Shine Training itself is delivered on time and properly. If a product ordered by the customer is not available for reasons beyond the control of FACE-SHINE.COM OG – Face-Shine Training Training, FACE- SHINE.COM OG – Face-Shine Training will promptly inform the customer. In this case, the customer has the right to withdraw from the contract. 6.4 If FACE-SHINE.COM OG – Face-Shine Training will be defaulted for reasons that FACE-SHINE.COM OG – Face-Shine Training is responsible, in default of delivery or delivery for such reasons impossible without FACE-SHINE.COM OG – Face-Shine Training intent or gross negligence is accusable, the liability of FACE-SHINE.COM OG – Face-Shine Training for damages is excluded. Further claims of the customer remain unaffected. In particular, the customer can withdraw from the contract by setting a reasonable grace period.

6.5 For delays in delivery that FACE-SHINE.COM OG – Face-Shine Training is not responsible for (force majeure, fault of third parties, et cetera), the delivery period will be extended appropriately. This applies in particular to contracts for the provision of services which are provided online if errors occur with the web server, Internet service providers, online payment processors or the like. The customer is informed of delays in delivery without delay. If the causes of the delay last longer than four weeks after conclusion of the contract, each party is entitled to withdraw from the contract.

§ 7 Retention of title and intellectual property

7.1 An ordered physical item remains the property of FACE-SHINE.COM OG – Face-Shine Training until full payment.

7.2 Prior to transfer of ownership, resale, leasing, pledging, transfer by way of security, processing, other disposal or transformation without the express consent of FACE-SHINE.COM OG – Face-Shine Training is not permitted.

7.3 Contracts for the provision of services include, in particular, access to image, sound and video material. In these cases, all rights to this image, sound and video material remain with FACE-SHINE.COM OG – Face-Shine Training. At best, the customer is only granted a temporary right of use limited to him; any transfer to third parties and any appropriation, such as downloading, is prohibited.

§ 8 Transport damage; Inspection and complaint obligations of the customer

8.1 If physical sales items are delivered with obvious damage to the packaging or to the contents, the customer must immediately complain about this, if necessary with the freight forwarder / freight service, and refuse acceptance. In any case, contact FACE-SHINE.COM OG – Face-Shine Training immediately.

8.2Hidden defects should be reported to FACE-SHINE.COM OG – Face-Shine Training immediately upon discovery.

8.3 The fulfillment of the obligations under points 8.1. and 8.2 has no influence on warranty claims of the customer.

§ 9 Warranty

9.1 The warranty claims of the customer in the case of defects in the purchased goods are governed by the statutory provisions, unless deviations result from the following provisions.

9.2 Damage caused by improper or contrary to the contract of the customer in the installation, connection, operation or storage of the purchased goods, do not constitute a claim for warranty. The inaccuracy and lack of conformity is determined in particular according to the manufacturer’s information, subsidiary to any ÖNORMen.

9.3 Warranty is excluded in particular for contracts for the provision of services, if the service is used in disregard of the warning and similar information provided.

§ 10 Guarantee

10.1 Any warranty will be in accordance with the manufacturer’s terms and will be described in the accompanying warranty card. Not explicitly promised warranty does not exist.

§ 11 Liability

11.1 FACE-SHINE.COM OG – Face-Shine Training is only liable for material damage if FACE-SHINE.COM OG – Face-Shine Training or vicarious agents of FACE-SHINE.COM OG – Face-Shine Training have caused it intentionally or through gross negligence , For damages to the person FACE-SHINE.COM OG – Face-Shine Training is liable only for grossly negligent or intentional causation.

§ 12 Set-off and retention ban

12.1 The customer is not entitled to offset his own claims against claims of grossly negligent or intentional causation, unless the claims of the customer has been expressly recognized by FACE-SHINE.COM OG – Face-Shine Training or legally enforceable or the customer’s claim has its legal basis in the same legal transaction as the claims of FACE-SHINE.COM OG – Face-Shine Training or FACE-SHINE.COM OG – Face-Shine Training is insolvent.

12.2 The customer is not entitled to withhold payments due to its own claims against FACE-SHINE.COM OG – Face-Shine Training, except FACE-SHINE.COM OG – Face-Shine Training does not provide its services from the same shop or does not properly or the Provision of the performance of FACE-SHINE.COM OG – Face-Shine training from the same business is at risk because of the poor fortune of FACE-SHINE.COM OG – Face-Shine Training.

§ 13 Data protection

§ 15 Jurisdiction and applicable law

15.1 Any dispute between FACE-SHINE.COM OG – Face-Shine Training and a customer will be settled solely by the court of competent jurisdiction for FACE-SHINE.COM OG – Face-Shine Training. If the customer is a consumer, such dispute will be settled by the court in whose district the place of residence, habitual residence or place of employment of the consumer is located.

15.2 These terms and conditions, all contracts that are subject to these terms and conditions and the contracts concluded under these terms and conditions are subject exclusively to Austrian law except for Austrian referral standards and except UN sales law.

§ 16 Place of fulfillment

The place of fulfillment for all shops is Vienna.

Legal cancellation policy

You may exercise your disclaimer by informing us by means of a clear statement (such as a fax or a letter sent by post) of your decision to cancel this contract or, if physical goods are left to you before the deadline, to return the goods. In the event that you wish to inform us by means of a clear statement of your decision to cancel this contract, you can use the attached model withdrawal form, which is not mandatory. You must return the goods to us immediately and in any event not later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the deadline of fourteen days. We bear the cost of returning the goods. You only have to pay for a possible loss of value of the goods, if this loss of value is due to an examination of the nature, characteristics and functioning of the goods not necessary handling them.

1.3 Note about exceptions

The right of revocation does not apply to contracts for the delivery of goods which are not prefabricated and whose manufacture is determined by an individual choice or determination by the consumer or which are clearly tailored to the personal needs of the consumer.
